Terms of Sale

These terms cover both digital image licences and physical prints purchased from Moments in Nature. The two are governed by different rules — please read the section that applies to what you're buying.

Digital images

1. What you are buying

When you purchase a digital image from Moments in Nature, you are purchasing a non-exclusive, non-transferable licence to use that image under the terms of the licence tier you selected. You are not purchasing the image itself, its copyright, or any intellectual property rights.

2. Licence tiers

• Personal — Home prints, personal social media, and private non-commercial use only. The image may not be used in any commercial context.
• Commercial — Websites, marketing materials, advertising, and other commercial projects. Attribution is not required but appreciated.
• Editorial — News articles, blogs, and editorial publications with photo credit to Estelle Erasmus / Moments in Nature.

For unlimited commercial use with the image removed from sale entirely, please email licensing@momentsinnature.co.za to discuss pricing and terms.

3. What is not permitted under any licence

• Reselling, sublicensing, or redistributing the image file to third parties.
• Claiming authorship or copyright of the image.
• Using the image in a way that is defamatory, misleading, or illegal.
• Using the image to train machine learning or AI models.

4. File delivery

Files are delivered as high-resolution JPEG images immediately after payment is confirmed. You will receive a download link in your account under My Downloads. Each file may be downloaded up to 5 times. If you experience a download issue, contact us and we will assist.

5. Resolution and quality

Images are sold as captured — resolution is shown on the product page before purchase. No upscaling or post-processing beyond the photographer's standard editing workflow is applied. The preview on the website is a watermarked, lower-quality version for display purposes only.

6. No refunds on digital sales

Because digital files are delivered immediately upon payment, all digital sales are final and non-refundable. If there is a technical problem with the file you received, please contact us and we will resolve it.

7. Copyright

All images are © Estelle Erasmus / Moments in Nature. Copyright is retained by the photographer in all cases. Purchase of a licence does not transfer any copyright or moral rights.

Physical prints

1. Orders

All prints are produced to order. Once your order is placed and payment is confirmed, production begins. Orders are non-cancellable once production has started.

2. Delivery

Prints are shipped within South Africa only via courier directly to your door. Delivery costs are calculated at checkout based on your province. Delivery times are estimated and may vary — you will receive a tracking number once your order is dispatched.

3. Returns & refunds

Because prints are made to order, we do not accept returns or offer refunds unless the item arrives damaged or defective. If your print arrives in an unacceptable condition, please email licensing@momentsinnature.co.za within 7 days with photographs of the damage and we will arrange a replacement.

4. Print quality

Colours may vary slightly from screen representations due to monitor calibration differences.

5. Copyright on prints

Purchase of a print grants you a personal, non-commercial licence to display the artwork in your home or private space. Reproduction, resale, or commercial display of the print is not permitted. All images remain © Estelle Erasmus / Moments in Nature.
